Terms and Conditions

Welcome to Samui Social (the "Platform"). These Terms and Conditions ("Terms") govern your access to and use of our services, including all content, features, and functionality provided through this Platform. By using Samui Social, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Acceptance of Terms

By accessing or using Samui Social, you confirm that you’ve read, understood, and agree to be bound by these Terms. These apply to all users, including businesses and visitors.

2. Services

2.1 For Businesses

Businesses may subscribe to a paid listing for an annual fee, which includes access to the following features:

  • Images: Upload a banner and logo (max size: 500 KB each).
  • Description: Add an engaging summary of your business.
  • Contact & Links: Include menu/price list links, website, social media, phone, and WhatsApp.
  • Video: Embed a YouTube or Facebook video (horizontal only, must be owned by you).
  • Map & Reviews: Display Google Maps location and link to your Google reviews.
  • Opening Hours: Add up to 3 time slots and optional holiday closures.
  • Gallery: Upload up to 8 horizontal images.

Events

  • Must relate to your subscribed business category.
  • Include a clear title, date, time, location, pricing, and booking/contact info.
  • Upload up to 4 relevant images.

Discounts & Promotions

  • Must be relevant to your subscribed category.
  • Use clear titles such as “Limited Time Offer” or “Exclusive Deal.”
  • Include original price, discounted rate, terms, and promotion dates.
  • Upload a high-quality image.

Optional Add-On Categories

Businesses can increase visibility by adding extra categories for an additional annual fee.

Payment & Renewal

  • All subscriptions are billed annually and are non-refundable.
  • Renewal reminders will be sent 30 days prior to expiry.
  • Non-renewed listings will revert to a free basic version.

Listing Claims or Removal

  • For removal or claim requests, email: info@samuisocial.com
  • Proof of ownership is required (e.g., ID or business registration).
  • We aim to respond within 30 days.

Legal Eligibility

All business owners submitting listings must be fully authorized to work in Thailand. This includes holding a valid long-term visa and a legal work permit where applicable.

By submitting a listing, you confirm your compliance with Thai laws. Samui Social reserves the right to share your information with Thai authorities if officially requested, or if your listing is suspected to be in violation of labor or immigration regulations.

2.2 For General Users

  • Free Access: Visitors can browse listings and content freely.
  • Free Registration: Optional, but requires valid email and accurate information.

3. User Conduct

  • Respectful Use: Users agree to use the platform legally and respectfully.
  • Prohibited Activities: No spamming, impersonation, fraudulent behavior, or abuse.

4. Limitations of Liability

  • Accuracy: We do not guarantee the accuracy or completeness of listings or content.
  • No Liability: Use the platform at your own risk. We are not responsible for any direct or indirect damages or losses.

5. User-Generated Content

  • Responsibility: Users are fully responsible for the content they submit.
  • No Endorsement: We do not verify or endorse user-submitted content.
  • Moderation: We reserve the right to remove content that violates these Terms but are not obligated to do so.
  • Legal Compliance: Businesses are solely responsible for ensuring their listings comply with all applicable laws.

6. Brand Usage and False Representation

The Samui Social brand name, logo, and platform visuals may be referenced by businesses listed on the platform strictly for promotional or advertising purposes (e.g., “As seen on Samui Social”). However, any unauthorized or misleading use—such as falsely claiming ownership, partnership, official affiliation, or co-development rights—is strictly prohibited. We reserve the right to pursue legal action against any party making such false claims, including but not limited to takedown requests, public correction, or legal escalation if necessary.

7. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes means you accept the updated version. Major changes will be announced via email or site notices when possible.

8. Governing Law

These Terms are governed by Thai law. All disputes will be resolved under the jurisdiction of Thai courts.
